Obtaining a patent.

Posted 05 September 2010 - 01:11 AM

I just want to patent a design for something to be a douche, and make my invention/design my property.

I've seen a commercial for a website that claims to make this process very easy, but I don't remember what it was.

What should I do?

The douche has already been patented so your efforts are in vain.

Patents are extremely expensive. In the neighborhood of $10k +

It isn't something one just up & does. It's rather serious. Lawyers, paperwork, & so on. But keep dreaming, dreamer.

Ahh yes, I think only police officers would use this, so I'm going to patent it.

I'm don't think so. 10k may be a standard attorney fee.

The nice thing about bureaucracy, it's all documented somewhere: http://www.uspto.gov...september15.htm

I don't think it's all that simple, but it's still something you can attempt yourself. There are a number of How to resources, and books.

I wouldn't go through some third party business that runs late night infomercials to do it.

Good luck.

Anything worth doing, is worth doing legally.

True, but omitting a professional legal representative doesn't imply you're doing the process illegally. There are cases where it may be ill advised not to seek professional help, but it's not criminal.

Don't forget that your patents can be easily challenged in court if they're weak too, so you would have to seek legal advice in writing the thing as well.

It's about 8,000 USD for a 50% chance at being awarded a patent: it's upwards of 3,000,000 USD to be able to defend it in a court of law.

I like patents and I'm a big fan of IP (properly used), but it is fundamentally a game of kings. If you're in a corporate environment, it's a wonderful thing to have: if you're just inventing things, yes, it might be good to get a patent if you think it's a million $30bn dollar idea- but you're not going to be able to defend it on your own, even if you have the patent. The only real way to cash in is to sell the patent, or at least for most people, but provided your patents are good enough, it can be a very real way to cash in.

Edit: you can't patent things which have already been released to the public ('prior art'). On the up-side, if you release the design publicly, neither can anybody else. IBM (as only one of many examples) has an active campaign to prevent other people from patenting things it makes by releasing inexpensive ideas in trade magazines, etc. If you want to learn more about patents and IP management type stuff, <shameless plug> this blog, by this company, is a good place to look.
