If you apply for a trademark for whatever it is you want to use, as long as it's not already taken, I assume you could then get the domain. However, I'm no laywer, so don't take my word for it.

I'd just go up in there and smack a bitch. That shit ain't right and they know it. That's theft. Who actually owns the domain? Maybe they could get the hoster to shut it off.

The goal is to have the registrar just transfer ownership of the domain. This way their SEO value doesn't take a hit for age of domain. The domain name will retain it's age.

The paper work will be filled on Monday. Of the two lawyers that have come to me for work, one of them is more than familiar with this specific area of law & already has the letter drafted up. I expect this to be a done deal by the end of the month.

All documentation for the whois information, registration information, & Ohio business registration information for all involved found it's way to his desk by end of business day Friday.

** Update **
The webhost has taken the site down, however I'm still waiting to hear anything regarding the transfer of the domain.

Just got the notification from the lawyer that my client won his case. I'll be transferring the domain today. Just through I'd drop an update.
