And I think common sense would say "they're both bottles, that start narrow, get thick about a third down, taper down, and get thick at the bottom." The only differences are the grooves and the logos.
If you removed the labels, people would be hard pressed to say which is which. On top of that, they change the styles of their bottles frequently, so those images are of soda bottles at one point in time, not even necessarily the same point.
So if they don't sue each other over the shape of their bottles...
