Enjoy those "freedoms". Judges can rename your kids...

Posted 12 August 2013 - 09:14 AM

Of course it happens in the deep south...

How is this even constitutional? I could see not being allowed to name a child something potentially abusive like a swear word or something, but this seems like a violation of the 1st amendment to me.

Quote

Ms Ballew said the name Messiah could cause problems if the child grows up in Cocke County, which has a large Christian population.

"The word Messiah is a title and it's a title that has only been earned by one person and that one person is Jesus Christ," the judge said.

The child may also have problems being non white in racist TN (if you've ever been there you'd know!), but they're not going to bleach the kid's skin! I hope the parents win this appeal and are able to get the hell out of TN!

Is This A Good Question/Topic? 1

Good.. if Ms Jaleesa Martin and this kid's father cannot get their last name right - after seven months - then certainly assisting them in a better child's name (over all) is a fine by me.

Other countries are known to do this.. Germany, New Zealand, etc.

A judge in New Zealand made a young girl a ward of court so that she could change the name she hated - Talula Does The Hula From Hawaii.

The judge obviously doesn't know what 'messiah' means, since more than one person has been considered a messiah through out history. A messiah is just a liberator of peoples, mostly used in abrahamic religions (more than just christianity).

I was just bitching about this on Facebook this morning!

I don't give a shit what other countries do! It is a judge's job to uphold the law - not to impose their personal religious beliefs on the people in their courtroom! Unless there is a law that specifically states a child cannot be named Messiah, the judge overstepped her authority.

Does this now set a legal precedent? Do we have to start a hunt for anyone named Messiah or Emmanuel? What about all the Latinos named Jesus? By Christian theology, they all refer to the same diety.

Would there be an outcry if the judge had been Muslim and declared the child could not be named Mohammed? What if she was Wiccan and declared a girl could not be named Diana?

Hell, why stop there?!? Let's just hand over the naming of all children to the judicial system... since we are now, as a society, apparently no longer capable of making our own decisions!

OMFG... the more I think about this, the more it pisses me off!

Freedom, as with many things, should not be abused. :)

I think it is appropriate in this case. It is for the child's own good. The word 'Messiah' obviously has significant connotations here. You would not want to name a child 'Devil' Freedom, as with many things should not be abused.

I can see this argument.

In the families region it obvsly has the chance for backlash.

Just look at their judge, and her awful argument for it. "There's only 1 messiah"... HA, uneducated twit doesn't even know her own religion.

But if the judge is that stupid, imagine everyone else in the area.

I say name the kid Messiah, and move.

There are 172 people in the United States with the LAST name Messiah [cite]. They need to change their last name. Because there is only one.

The fact that this is even happening is asinine.

Why are judges not renaming celebrity babies? Like Apple and North? I'd much rather grow up as Messiah Martin than fucking North West.

... because this lady is a "Child Support Magistrate [...] [that] serves the 4th Judicial District of Tenn. including the following counties: Cocke, Grainger, Jefferson, and Sevier" and I am certain Apple, North West, and so on are a little outside her authority in the holler.

That wasn't my point, modi.

I'm sure, somewhere in her jurisdiction, is a severely supidly named child. She needs to hunt him down and change his name for his own protection.

I can see this argument.

Similar to the family that named their child Adolf Hitler.

I agree. The argument can be that it is in the childs safety, but honestly it's the parents decision (in both cases). I think this is a situation of abuse of power. The judge didn't like it & is in a position to do something about it.
